A debate on regulating digitalhealth and artificialintelligence in medicine has recently been picking up steam. In this new original research article just published, we describe key differences between both digital health products and classical medical devices & drugs as well as digital health actors and established healthcare actors. We then analyze the regulatory landscape, highlight loopholes and blindspots prone to abuse or otherwise endangering patients and consumers and investigate alternativeapproaches to regulation.
